Terms of Service
Ember Bend is run by Aaron Miler, an individual in Oregon, USA. In these terms, “I” and “me” mean Aaron Miler. These terms cover emberbend.com and the projects published under Ember Bend, such as Pit Wall. By using them, you agree to these terms.
The projects
Ember Bend projects are personal projects. They are provided free of charge. A project may be labeled experimental, which means it may change, break, or lose data.
I may change, suspend, or stop any project at any time, with or without notice.
Your use
- Use the projects only in ways that are legal where you are.
- Do not try to disrupt, overload, or gain unauthorized access to any project or the systems it runs on.
- You are responsible for the accounts you connect to a project, and for keeping your own copies of anything important.
I may block access for anyone who does not follow these terms.
Source code
Where a project’s source code is published, its license (usually MIT) governs your use of that code.
No warranty
THE WEBSITE AND ALL PROJECTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I DO NOT PROMISE THAT ANY PROJECT WILL BE AVAILABLE, ACCURATE, OR FREE OF ERRORS.
Limitation of liability
TO THE EXTENT ALLOWED BY LAW, I AM NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE WEBSITE OR ANY PROJECT. MY TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID ME FOR THE PROJECT IN THE PRIOR 12 MONTHS OR US $50.
Privacy
How projects handle data is described in the Privacy Policy.
Governing law
These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict of law rules.
Changes
If these terms change, I will update the date at the top of this page. Continuing to use a project after a change means you accept the new terms.
